Contraception ruling is a symbolic blow to the health care law

The Supreme Court struck a second blow against the health-care law Monday with its decision to narrow the so-called contraception mandate, an aspect of the federal program that was not central to its existence but was deeply cherished among liberal and many women's groups.


Unlike the court's decision two years ago that gutted the law's mandatory Medicaid expansion, severely limiting the law's reach, the effect here is more peripheral. The provision was not part of the main law but rather was laid out in regulatory language issued by the Obama administration. Millions of women who receive birth control at no cost through their company health plans are likely to keep it.


Still, women who work for closely held, for-profit companies whose owners have religious objections to contraceptives may feel an impact. And the ruling is a symbolic blow to the law, which has persevered through legal and political challenges since its enactment four years ago but today stands not entirely whole.


Shortly after the ruling was handed down, the Affordable Care Act's critics pointed to it as further evidence of the law's shortcomings.


'Obamacare is the single worst piece of legislation to pass in the last 50 years, and I was glad to see the Supreme Court agree that this particular Obamacare mandate violates the [law],' Senate Minority Leader Mitch McConnell (R-Ky.) said in a statement.

Some supporters lamented the ruling, but insisted that the law remains strong and that Monday's decision will have a minimal impact on its core goal - reducing the number of the nation's uninsured.


They noted that the law itself only required company insurance plans to cover 'preventive' services. The Department of Health and Human Services then used guidelines established by the Institute of Medicine to label birth control, intrauterine devises and sterilization methods such as tubal ligation services that are integral to women's preventive health.


'Politically, of course, the case may be trumpeted as a major defeat for the ACA, but that is simply not true,' said Timothy S. Jost, a health law professor at Washington and Lee University and a supporter of the law. 'This case is not about the ACA. It is about religion, about employer and employee's rights, about corporate law, and I suppose about public health law, but it is not an existential challenge to the ACA.'


It is the latest turn in the tortured path taken by the Affordable Care Act, which was enacted in 2010 after a pitched political battle and has encountered obstacle after obstacle in the four years since.


The Supreme Court upheld the constitutionality of the law in June 2012, at the same time that it made the Medicaid expansion voluntary.


The contraception mandate was a prime example for the law's supporters as they sought to paint women as its prime beneficiaries. Women's health and liberal groups hailed the law as an antidote for years of inequality, with women routinely paying more than men for their health-care and health insurance.


But for critics of the law, the mandate became the most high-profile exhibit for what they viewed as an overreach into Americans' lives. The mandate applied not only to private companies but also religiously affiliated nonprofits that employ large numbers of workers from various backgrounds, such as Catholic hospitals.


A second wave of legal challenges to the contraception mandate, from those nonprofits, is also making its way through the courts. But a challenge striking more directly to the heart of the law looms: a wave of suits from citizens and employers who argue that the government is wrongly handing out tax credits in half of the states. If successful, this argument would cut at the heart of the law by making health insurance unaffordable for many people.


GAO: CT small businesses paid more than most others for health care

Washington - Federal researchers have determined that Connecticut's small businesses and non-profits pay more than those in every other state - except Alaska - to provide health care coverage to their workers.


The Government Accountability Office studied the average premium charged by small group policy providers in all 50 states and the District of Columbia and determined it cost an average of $6,080 to cover an individual in Connecticut in the first quarter of 2013. That was just before implementation of the Affordable Care Act's prohibition against considering the health or gender of members of a small group when determining premiums.


Only Alaska, with an average annual premium of $7,691, had costlier small group health insurance plans than Connecticut. Coverage was cheapest in Kentucky, which had an average premium cost of $1,311.


Some of the highest premium rates were in the Northeastern United States, which tends to have high medical costs and an aging population.


But even so, Connecticut's insurance costs were far higher than its neighbors. Maine's average premium was $4,407, Rhode Island's was $4,483, New York's was $4,756, Massachusett's was $4,470 and Vermont's was $5,232.


Connecticut Insurance Department spokeswoman Donna Tommelleo said the state-by-state comparison is skewed because 'in addition to high medical costs, Connecticut also has more state-mandated covered benefits than many states.' The Connecticut Insurance Department approves the rates charged by health insurance companies operating in the state.


Tommelleo said demographics and the cost of medical services by geographic location were also factors that resulted in a difference in premiums from state to state.


Although the average premium for small group coverage was high in Connecticut, it varied from company to company and type of coverage - for example, preferred provider policies (PPO's) and health maintenance organizations (HMO's) charged different premiums. Deductibles, co-pays and out-of pocket maximums also influenced premium rates.


So did the town or city where an individual in Connecticut lived.


The GAO report said 'ranges could vary widely within a particular state for a number of reasons, including significant differences in the services covered, cost sharing features selected, and the factors considered when insurers set the premium rates for each small employer.'


Although the ACA ended the insurer practice of considering the health and gender of its members when determining rates, age can still be a factor.


And, especially before the ACA set new restrictions on insurers, so could the actions of a state insurance department.


The GAO said state regulators could limit 'how insurers vary premiums for different small employers, the factors such as, age, gender, and health status of employees that could be considered when setting premiums rates for the employer group, and the range of variation among premiums rates across employers.'


The study was requested by Sen. Orrin Hatch, R-Utah, who hoped to establish a baseline of small group premium costs before the ACA went into effect. He believed it would help prove the health care law will drive up premiums for small businesses.


The Affordable Care Act exempts businesses with 50 or fewer full time employees form the requirement that they offer employees health insurance coverage and offers tax credits to some small businesses that do offer coverage.


But starting in 2016, larger businesses will be required to cover their workers or pay a fine.

Kim was sitting at a table chatting with her sisters Kourtney and Khloe, and that's when she brought up Bruce's hair: 'Has anyone seen Bruce's hair and why it looked teased ?'


Kourtney responds saying she hasn't noticed, but 'we should have made him cut it more, now I feel bad.'

Have Kim and Khole Kardashian helped bring two of our favorite rappers closer together? We already know that both French Montana and Kanye West are working on their new albums, but French reveals to MTV News that they've already banked a few tracks together.


French tells us that his Mac & Cheese 4 album will arrive in November, after he wraps up work on Lil Durk's debut LP.


'Right now I'm working on Durk's album and I'm getting my next single together, it's about to drop next month,' he told MTV News on the 2014 BET Awards rep carpet on Sunday (June 29). [It will be] Mac & Cheese, and it's like a follow up to all my mixtapes that I had.'


'I got Kanye on the album, I got will.i.am on the album, I've got Durk on the album and Chinx,' he revealed.


And what's it been like working with Yeezy? 'I love it - we've been working on his album and mines so we're just going back and forth.'


So far, French says that they've banked about five tracks, and it seems like we'll be hearing the first one on his project.


When he's not in the studio, French is busy with his new boo, Khloe Kardashian.

But even though Kim admitted on the June 29 episode of Keeping Up with the Kardashians that it was 'difficult to balance my career and being a mom,' she made it clear that she will ALWAYS put Nori's needs above those of her fans. Kim's schedule was totally packed during her trip to Vienna in February, but she tried her best to plan everything around North.


One day, however, an autograph signing with fans was booked for Kim without her knowledge. She had been planning to finish her day by 1 p.m. so she could get back to the hotel to feed North, 1, and put her down for her nap, but the signing had been scheduled for 2 p.m. What's a working mom to do!?


'Before, I would have never done anything to disappoint the fans or anyone,' Kim explained in a confessional, 'but now my daughter becomes my No. 1 priority.'

Kim Kardashian: It's 'Difficult' To Balance Career & Being A Mom

Unlike some Hollywood moms - we're looking at you, Gwyneth Paltrow - Kim solved her dilemma like a true pro, without any complaints. She simply moved the signing up to 1 p.m. so she could get home early to be with her precious daughter.


'It is definitely way more difficult to balance my career and being a mom, but everyone does it,' Kim said. 'I don't want to disappoint anybody but you also have to have boundaries.'

Kim Kardashian and Kris Jenner Get Attacked by Kanye West Impersonator at ...


On Sunday's latest episode of Keeping Up With the Kardashians, Kim Kardashian and Kris Jenner's trip to Austria turns into a nightmare while Kourtney Kardashian resists moving into her new home with Scott Disick!


While babysitting for Kourtney and Scott, Kim asks her niece and nephew if they will help hold baby while Kim walks down the aisle at her wedding to !


While at lunch with Khloé Kardashian and Kourtney, Kim reveals that she has been selected to host the Vienna Opera Ball in Austria and will be attending the event with Kris and North! It's a white tie fundraiser and one of the most prestigious events in Austria.


Kourtney drives over to meet Scott at their new house. It's stunning!



It has a bigger backyard for the kids to play in and a basketball court!



Later, Kourtney admits that she's been feeling extra stressed lately. Her assistant suddenly quit and there is lots to be done with the move, which is starting to freak Kourtney out.



Kim and Kris arrive in Austria and are extremely excited! But when they arrive at their hotel, Kris notices that something isn't quite right...


As she unpacks, she discovers that she's been robbed!



Several things have gone missing from Kris' suitcase, including her favorite sunglasses and a fur throw that Kanye gave her!


They file a police report with the hotel staff but Kris is not happy with the situation.



Back at the new house, Scott and Khloé are shocked when they discover a rat!



Then Scott sees another one...



He was only kidding, but all it takes is one rat to make Kourtney not want to move into the house!


Back in Vienna, there is a scheduling mix-up when Kim finds out that she is supposed to sign autographs for fans later that afternoon. The only problem is, this is the first time that she's heard of it!


Kris and Kim talk to their host Wolfgang and reach a compromise: Kim will come and wave to the crowd after her appearance but she can't stay the whole time because she needs to get back to the hotel and feed her baby.

Bruce does offer her a good piece of advice: he suggests letting the cat run around the house to take care of the rat problem!



While getting ready for the ball, Kim and Kris are informed that they're running behind and need to leave ASAP because once the President arrives at the ball, no one else will be able to get in.


Kim and Kris hustle out the door but they feel super rushed!



Back at the house, Kourtney demands that Scott catch another rat hiding in a corner, but when Scott comes to her rescue, it's nowhere to be found!



Kourtney leaves the house again, which frustrates Scott because he wants to get the moving in process finished already.


Kim arrives at the Vienna Ball and looks gorgeous!



The place is packed!



Then suddenly Kim and Kris see this shocking sight...



Some random man is dressed up in blackface and is impersonating Kanye!



Kim and Kris are extremely uncomfortable, but first they must wait to do their live interview with a German TV host.


What they hear next shocks them:



While the man was trying to be funny by making a reference to a Kanye song, Kris and Kim find his comment to be extremely offensive and they're ready to leave.



Kourtney pops by the new house and is stunned to find that Scott has already moved in. He's lying on a blow-up mattress on the floor!


Scott tells Kourtney that she needs to move past her fear of change because it's holding her back from moving into their dream home.



Kris and Kim are relieved to finally be home tell Khloé all about their awful trip!


While on the plane, some woman started screaming racist remarks at Kim and her baby. It got so bad that the pilot had to come out and talk to the woman!


The experience made Kim extremely uncomfortable, especially since it was the first time she had ever experienced racism.



It's official moving day and Kourtney has finally come to terms with the big move. She admits to Bruce that she isn't the best when it comes to dealing with change, but she has taken the necessary steps in order to make the move easier on herself.


She had exterminators come in to take care of the pest problem, not to mention that the people who bought their old house want to move in ASAP, so she was forced to speed up her moving process.



Inspired by her negative experience in Vienna, Kim decides to start writing a blog to encourage more positivity and acceptance in the world. Now that she's a mother, she doesn't ever want her own children to go through what she experienced.


By writing about her thoughts and feelings, Kim hopes to serve as a positive role model for people everywhere!

Rick Ross was arrested in North Carolina on Friday because he didn't show up for court!


Back in 2013, the 38-year-old rapper was arrested for a misdemeanor marijuana possession charge, and was due to show up at the mandatory hearing for it last week.


Unluckily for Ross, he was performing at SuperJam in Greensboro, so the cops easily nabbed him, and hauled him in.


However, bail was only $1,000, which the Rich Is Gangsta rapper forked over in no time, and was released.


Then, Ross hopped on a plane to Los Angeles because he's set to play at the BET Experience on Sunday night!

No matter how hard you try, it's nearly impossible to resist becoming an enthusiastic or begrudging member of the Kardashian Kult. We don't know how it happened, nor do we understand why, but the reality TV family has become an actual topic of conversation, debate and articles -- like this one, sorry!



The reigning Queen of the Kardashian Klan is, of course, Kim, who, through a combination of selfies, marriages, divorces, civil rights activism, a video game, and a sex tape, has managed to make herself the Elizabeth Taylor of our time... or something.


A Brooklyn-based artist is calling us all out for our Kardashian-centric ways through a series of dizzying depictions of Mrs. West as a variety of religious icons. Hannah Kunkle delivers Kardashian as the Virgin Mary, Medusa, the devil and even Kleopatra. The 23-year-old artist's garish style, somewhere between net art and religious tapestry, perfectly captures the absurdity of our nation's Kardashian obsession and predilection towards celeb idolatry in general.


'Kim Kardashian is the subject of this series because she is someone I and many others are fascinated with without even sometimes knowing why,' Kunkle explained to The Huffington Post. 'She is everywhere we look and knowledge of the ins and outs of her life is almost unavoidable... Kim Kardashian has such a strange version of fame. We don't totally understand what makes her so fascinating.'


Kunkle's work recently went on view in a Bushwick exhibition titled 'The Passion of Kim Kardashian.' Not too surprisingly, the religious community was unamused. ' It's deplorable,' Pastor Reggie Stutzman of Real Life Church told The New York Daily News. 'It's sacrilegious, irrelevant, and disrespectful... It's idol worship.'


The Hindu community wasn't too keen on Kunkle's artistic vision either. 'I am certainly not happy about this,' said Dr. Uma Mysorekar, of the Hindu Temple Society of North America. 'Any religious symbol should not be used or abused.'


Yet Kunkle, who thought the backlash was 'pretty hilarious,' wasn't about to let religious tradition get in the way of celebrity obsession. ' Kim Kardashian is God,' she summarized to VICE. 'She's crazy bodacious and has the nose job of an angel. I don't know if she's omniscient, but no one can deny she's not omnipresent. Kim floats above us all, even the deniers and the haters. We have accepted her into our lives via television screens, memes, and Instagram feeds. If Jay Z is the father and Yeezus is the son, then she is the ever-present holy ghost of pop culture.'

Claudia Gordon spent 14 years chasing down bad boys as a Philadelphia policewoman. As a woman officer, Gordon occasionally ran into a perp who was thinking, 'Whatcha gonna do?'


Bad move, bad boy.


'They think women are weak,' said Gordon, 59, who retired in 2006. 'But we're not as weak as they think.'


On the street, there was no intimidating Gordon. But buying health insurance on the Affordable Care Act marketplace - well, that rattled her. Like so many others who tried to buy health insurance on healthcare.gov last fall, Gordon had to make a couple of attempts to finally get her plan, and only then with the help of a navigator.


But today she couldn't be happier.


'I would tell anyone who would listen to me to check out the Affordable Care Act,' she said.


Gordon's first try with the ACA marketplace was in October. With her city health insurance coverage ending on Dec. 31 and having some health issues, Gordon needed to find a plan. She knew about the ACA but wasn't sure how it worked.


So she called her daughter, Latanya Ivey, a teacher living in California, who instructed Gordon to log on to the website to see what plans were available.


Good advice, especially if you lived in California, where the state-run marketplace was humming along.


But in Pennsylvania, as in other states using the federally operated exchange, the fall had turned into a season of frozen screens and vanishing patience.


Nevertheless, Gordon followed her daughter's advice and typed in the healthcare.gov address. Sure enough, her computer 'froze up.'


'I was spooked by it,' she said. 'I just shut my computer down.'


Ivey persuaded Gordon to try again. She got through and was able to find a plan similar to the one she had with the city, a Preferred Provider Organization (PPO).


'I saw the plan, and it would cost me $800 a month,' she said.


Paying that kind of monthly premium would pretty much leave Gordon with little for anything else. She decided to go uninsured.


She called her daughter to give her the news.


'She said, 'Mom, it's not like that,' ' Gordon said. The monthly premium 'depends on your income.'


Gordon's daughter told her to contact a navigator to help with the application process. A skilled, impartial navigator can help people understand their health insurance options, including eligibility for tax-credit subsides that can greatly reduce monthly premiums.


Gordon vetoed the suggestion. She didn't want a stranger knowing her business. So Ivey went all Nike on her mother, ordering her to 'just do it.'


On December 6, Gordon walked into the Campaign for Working Families office at 12th and Chestnut Streets. The organization was working with navigators and certified application counselors from several groups.


The navigator was friendly, but Gordon was still nervous and certain that she would walk out the way she came in - without insurance. Gordon didn't want a Health Maintenance Organization (HMO) plan because 'I didn't want to deal with referrals and all that stuff.' It was a PPO policy or nothing for her.


They looked at Independence Blue Cross' silver-tier PPO plan and did some calculation. Gordon was dumbfounded when the navigator said that her monthly premium would be $135.


'I was amazed,' she said. 'So I signed on.'


Her new plan comes with a $250 deductible - under the city plan there was no deductible - and a co-pay for doctor's visits. Gordon doesn't think her plan's $2,250 maximum annual out-of-pocket cost is worrisome based on her current situation. She also bought a standalone dental plan.


Gordon worried when January rolled around and a bill from Independence for her monthly premium didn't arrive.


The customer-service representative reassured her that she was covered and would get a bill in February. It came as promised and she has been paying monthly ever since.


In April, Gordon used her new health insurance for the first time when she visited her primary care physician. She was astonished that her share of the bill for lab work was $5.


'I got the bill and looked at it and looked at it and said, 'This can't be right,' ' she said. 'I said, 'I hope this isn't an oversight.' '


Now that she understands how the ACA works, when friends ask her about buying insurance on the marketplace she simply tells them, 'Try it. You'll like it.'

It may have been Khloe Kardashian's 30th birthday celebration, but, as per usual, all eyes were on Kim Kardashian. The reality star, 33, wore a royal blue Ulyana Sergeenko corset dress with a thigh-high slit and her favorite Tom Ford gold chain heels.

Kim Kardashian: North Attacked By Racist on Airplane


In a clip from the new season of Keeping Up With The Kardashians, Kim Kardashian tells her family a story about how a racist woman on an airplane verbally attacked her and baby North West. The altercation took place in a first-class cabin.


In a clip from an upcoming episode of their reality show, Kim explains to her sister Khloe how a horrible lady, who was seated next to the famous family reacted when baby North began to cry.


Kim was flying with her daughter and her mother and manager, Kris Jenner. Kim fell asleep during the flight and Jenner was watching the baby. Kim explains how she suddenly wore up hearing a lady scream, 'Kanye West's Baby!' Startled, the reality star says she quickly jumped up to protect North West.


Kim Kardashian claims that the lady then began attacking her with racist slurs. The lady apparently stood in the middle of the aisle on the airplane and began screaming, at the top of her lungs, 'She's with a black guy, and that baby is black!' The lady also yelled, 'You need to shut that black baby up!' Kris Jenner chimed in saying that the situation was truly crazy.


In the clip, Kim does not clarify how she or her mother reacted to the crazy lady screaming. No word about if a flight attendant stepping in and calmed the situation. However, usually if a person is out of control on a flight, an emergency landing is used as an option, for the safety of the passengers. Kardashian also did not tweet about the incident after it happened, which is curious, since it seems like this is something worth sharing.


Khloe said that if this would have happened to her, she would have responded, 'hashtag, I only like black c**k.' However, neither Kris Jenner nor Kim laughed. Then Khloe said that she would have punched the lady in the face. Kim responded that she wanted to, but they were on a plane, insinuating that she feared that she would be arrested for creating a disturbance. The question is: why wasn't the loud racist passenger arrested for creating a disturbance?


This was not the first time the reality star was put in an uncomfortable situation due to racism. When Kardashian went to Vienna Ball, a white man came approached her, wearing full black face, and said he was Kanye West. Kardashian said she thought it was a sick joke and totally inappropriate. However, her rep says that Kardashian endured the ball another hour or so, until she heard another racist comment, so the reality star left the ball upset.


It is shocking to hear that Kim Kardashian and baby North were attacked on a plane with a racist rant from another passenger. Maybe this is why Kim does not take North everywhere with her, or why she only flies on private planes. Hopefully this story will continue to teach that it is never okay to attack others for their life choices, race, gender, or anything else that makes them different.

That was the newlywed's uniform du jour as she checked out real estate in N.Y.C. on Friday with her mom, Kris Jenner, and sister Kendall Jenner.


Kardashian, 33, and her husband, Kanye West, 37, are looking for a new East Coast home, a source confirms to PEOPLE.


The rapper already owns a bachelor pad in Soho, but they are looking for a larger home that has room for their daughter, North, 1. 'They need a bigger space with private parking,' the source says.


Kardashian checked out a $17.25 million townhouse in Greenwich Village that has six bedrooms, seven baths, a private garden and private parking inside the building, and a $12.99 million penthouse with a 1,500-sq.-ft. terrace complete with private pool, the New York Post reports.


The family, who are currently staying with Kardashian's mom in L.A. while they renovate the Bel Air mansion they bought in January 2013 for $11 million, joked in April's magazine that they would be keeping West's L.A. home to store Kardashian's giant wardrobe. 'We have a 'walk in' house,' West joked.

Kim Kardashian and Kanye West have been given The Simpsons-treatment in a number of hilarious animations by artist aleXsandro Palombo.


While the artist has no connection with the official 20th Century Fox show, Kim and Kanye certainly make for convincing characters.


And perhaps it won't be long before the pair are invited on to the hit show.


They have already graced the cover of Vogue Magazine this year, so a guest spot on The Simpsons doesn't sound too far-fetched.


Kim recently revealed that while she no longer goes out clubbing, she reserves her raunchy dance moves for the bedroom.


She said in an episode of her reality show: 'My twerking skills are for the bedroom, not the club.'


Kim was speaking with her mother Kris Jenner, sister Khloe Kardashian and half-sister Kendall Jenner during a Soul Cycle class and during the workout session, the showbiz matriarch was the subject of a number of mean comments from her younger daughter.


As Kris started clapping and dancing to the music, Kendall blasted: 'Do you always have to be the centre of attention? It's so annoying.'


'Eww mom, you're so embarrassing, you need to act your age.' She then muttered: 'Desperate f***ing w***e.'


Kris, 58, didn't appear to hear the comment and later told her daughters: 'This reminds me of being in the club, for real. I love the music, I love the energy, everyone's so excited.'


Kendall snapped: 'Why are you going to clubs? This is so embarrassing.'


Kris said she simply liked 'being out an about', prompting the teenager to brand her an 'embarrassment to the family'.


Sounds like it could make for an interesting episode of The Simpsons.


When a Health Plan Knows How You Shop


There may be a link between your Internet use and how often you end up in the emergency room.


At least that's one of the curious connections to emerge from a health care analysis project at the insurance division of the University of Pittsburgh Medical Center.


U.P.M.C. is a $12 billion nonprofit enterprise that owns hospitals in western Pennsylvania as well as a health insurance plan with about 2.4 million members. It is at the forefront of an emerging field called predictive health analytics, intended to improve patients' health care outcomes and contain costs. But patients themselves are often unaware of the kinds of intimate details about their households that insurers and hospitals may use to try to sway their treatment decisions.


The Pittsburgh health plan, for instance, has developed prediction models that analyze data like patient claims, prescriptions and census records to determine which members are likely to use the most emergency and urgent care, which can be expensive. Data sets of past health care consumption are fairly standard tools for predicting future use of health services.


But the insurer recently bolstered its forecasting models with details on members' household incomes, education levels, marital status, race or ethnicity, number of children at home, number of cars and so on. One of the sources for the consumer data U.P.M.C. used was Acxiom, a marketing analytics company that obtains consumers' information from both public records and private sources.


With the addition of these household details, the insurer turned up a few unexpected correlations: Mail-order shoppers and Internet users, for example, were likelier than some other members to use more emergency services.


Of course, buying furniture through, say, the Ikea catalog is unlikely to send you to the emergency-room. But it could be a proxy for other factors that do have a bearing on whether you seek urgent care, says Pamela Peele, the chief analytics officer for the U.P.M.C. insurance services division. A hypothetical patient might be a catalog shopper, for instance, because he or she is homebound or doesn't have access to transportation.


'It brings me another layer of vision, of view, that helps me figure out better prediction models and allocate our clinical resources,' Dr. Peele said during a recent interview. She added: 'If you are going to decrease the costs and improve the quality of care, you have to do something different.'


The U.P.M.C. health plan has not yet acted on the correlations it found in the household data. But it already segments its members into different 'market baskets,' based on analysis of more traditional data sets. Then it assigns care coordinators to certain members flagged as high risk because they have chronic conditions that aren't being properly treated. The goal, Dr. Peele said, is for the insurer to steer those patients to primary care physicians or specialists who can provide care that is more coordinated, more consistent and less costly than sporadic emergency-room visits. The system might pinpoint, for example, high-risk asthma patients who have not yet been prescribed inhalers - and try to manage their care before they end up in emergency rooms with asthma attacks.


The very idea of using consumer data-mining and marketing segmentation on patients troubles some technology and health law experts. Their concern is that such practices could ultimately result in the inequitable provision of medical care.


'This intensive, intrusive kind of data analytics that leads to differential treatment of customers, even if we are fine with it in the business context, needs to be disclosed in the medical context,' says Frank Pasquale, a professor in health care regulation at the Seton Hall University School of Law.


Analyzing details about household attributes and habits of individual consumers is a longstanding practice in retailing, travel and finance. Credit card marketers, for instance, may analyze consumers' buying patterns and financial wherewithal to decide whether to pitch them elite-level special-privilege cards.


Now two factors are converging to speed the adoption of these techniques in medicine.


We live in a sharing society. While older generations may still prefer to keep their health status separate from their shopping and social circles, digital natives are now publicly swapping minutiae about their medical conditions on patient sites and social networks. And fitness-tracking devices that personalize messages for users, based on their workouts and sleep routines, are proliferating.


Second, the new health care law encourages hospitals and medical groups to contain costs for certain patient populations. To do that, providers are turning to more sophisticated analytics.


In the vanguard are insurers like U.P.M.C., along with specialized marketing companies. Predilytics, a health care analytics company in Burlington, Mass., taps into socioeconomic, demographic and consumer purchasing data for health insurers seeking to identify those highest-risk members who could benefit most from medical intervention.


After an East Coast insurer asked for an analysis of hospitalization trends among its members, Predilytics discovered that patients who couldn't get timely appointments with their primary care doctors or who lacked transportation were more likely to end up in the hospital. That kind of finding explains why analytics companies may include household car ownership and other consumer data in their health care prediction models.


'What we are really doing is looking at multifactorial data and systemic issues that are getting in between individuals and their ability to maintain the highest health status,' explains Chris Coloian, the president of Predilytics.


Some specialized health care marketing companies are tapping into specifics on individual consumers to help hospitals identify their most profitable patients and encourage them to seek more medical care.


MedSeek, a software and analytics company in Birmingham, Ala., offers services intended to help hospitals 'virtually influence' the behavior of current and would-be patients. According to MedSeek.com, the company offers a '21st-century tool kit' that can refine health care marketing pitches based on sex, age, race, income, risk assessment, culture, religious beliefs and family status. One client, Trinity Health System in Michigan, used MedSeek's services 'to scientifically identify well-insured prospects,' among others, and encourage them to schedule screening tests and doctor visits, a company case study said.


In a blog post this month, Bill Andrae, MedSeek's vice president for client strategy, described other techniques for influencing well-insured patients. Hospitals could send birthday messages 'to all high-value men and women,' he wrote, or notify 'profitable individuals 18 and above' about special round-the-clock health care call-in lines staffed by nurses, and encourage those revenue-generating patients to schedule medical tests or appointments.


After I sent questions by email, MedSeek removed the blog post. The company did not respond to the questions themselves.


Hospitals have long tried to appeal to moneyed patients by offering them specially furnished floors or private rooms. But specifically targeting profitable patients and trying to channel them into moneymaking medical procedures is different, health experts say, because it could be problematic for them - and perhaps more so for so-called low-value patients.


The pitches might encourage the worried well to have unnecessary screening tests, for instance, potentially putting them at risk for false alarms and unneeded biopsies. And by devoting so much attention to pulling in low-risk or well-insured patients, health providers could end up overlooking - or not having timely appointments available for - ailing, poorly insured patients.


'Is the larger mission to improve public health, or to make insurers and hospitals more profitable?' asks Anita L. Allen, a privacy law expert and the vice provost for faculty at the University of Pennsylvania. 'I think we should be careful of running gung-ho into an area of health care analytics that may disadvantage deserving patients.'


In a more-data-the-merrier culture, patients may ultimately be unable to choose whether their health insurers know they prefer organic foods, hunt big game or own a dog. If health insurers mistakenly peg certain people as dog owners, patients probably won't find that out, either. ( Acxiom, one of the sources for the household information U.P.M.C. used in its prediction models, has publicly acknowledged that its details about consumers can be out of date or just plain wrong.)


Perhaps health insurers and hospitals that use consumer data to steer patients into different treatment tracks should be required to make public their predictive findings and prove that they are plausible and equitable, suggests Professor Pasquale at Seton Hall.


'It would be great if these programs do work,' he says. 'But they are kind of untested right now.'
